Contract award criteria

Overview
This regulation states that contracting authorities must base the award of public contracts on the most economically advantageous tender (MEAT) assessed from the point of view of the contracting authority. The regulation also sets out the rules relating to contract award criteria and how the MEAT should be determined.

The award criteria must not have the effect of giving the authority an unrestricted freedom of choice to identify the MEAT
Key considerations at this commercial stage
Contracting authorities should:
- remain mindful that award criteria will be considered to be linked to the subject-matter of the contract where they relate to the works, supplies or services to be provided under that contract in any respect and at any stage of their life cycle
- note that relevant factors when considering whether the award criteria are linked to the subject matter of the contract include the specific process of production, provision or trading of the works, supplies or services, or a specific process for another stage of their life cycle, even where those factors do not form part of their material substance.
