Publication of information on Contracts Finder about contracts awarded

Overview

This regulation provides that, where a below-threshold public contract is awarded, the contracting authority must publish information relating to the award on Contracts Finder within a reasonable time.

The information to be published on Contracts Finder must at least cover:

  • the name of the supplier
  • the date on which the contract was entered into
  • the value of the contract, and
  • whether the supplier is a small and medium-sized enterprise (SME) or a voluntary community and social enterprise (VCSE).

Regulation 112 allows contracting authorities to withhold information in certain circumstances (for example, where publication would impede law enforcement or be contrary to the public interest).

Contracting authorities must have regard to any guidance issued by the Minister for the Cabinet Office in relation to the form and manner of the information to be published on Contracts Finder and the timescales for publication of this information.

Key considerations at this commercial stage

Contracting authorities should:

  • ensure that the information required by this regulation (i.e. regulation 112) is published on Contracts Finder within a reasonable time following the award of a below-threshold contract
  • consider whether any of the information required to be published under this regulation should be withheld
  • have regard to guidance issued by the Minister for the Cabinet Office in relation to the form and manner of the information to be published on Contracts Finder and the timescales for publication of this information.
