Research and development services

Overview

This regulation provides that Part 2 PCR 2015 applies to certain public service contracts for research and development services if:

  • the services are funded entirely by the contracting authority awarding the contract, and
  • the benefits of the research and development are received exclusively by the contracting authority for use in the conduct of its own affairs.

Objective at this commercial stage

Part 2 PCR will not apply to any contracts referred to in this regulation (i.e. regulation 14).

Key considerations at this commercial stage

Contracting authorities should:

  • ensure the subject-matter and circumstances of any research and development contract are reviewed and consideration is given as to whether this regulation (i.e. regulation 14) will apply.
