Service contracts awarded on the basis of an exclusive right

Overview
This regulation provides that Part 2 PCR 2015 does not apply to public service contracts awarded to another contracting authority due to an exclusive right the contracting authority being awarded the contract has under a law, regulation or published administrative provision.

Part 2 PCR will not apply to any public service contracts covered by this regulation (i.e. regulation 11).

Contracting authorities should:
- ensure the circumstances of any public service contracts awarded to another contracting authority are reviewed and consideration is given as to whether this regulation (i.e. regulation 11) will apply.
Legal framework
There is no direct equivalent section in the Procurement Act 2023.
