Specific exclusions for service contracts

Overview

This regulation provides that the following public service contracts are excluded from Part 2 PCR 2015:

  • contracts for the acquisition of land and rights over land
  • contracts for programme material or broadcasting time
  • arbitration or conciliation services contract
  • contracts for legal services connected with litigation or the exercise of official authority
  • loan contracts and contracts for financial services related to the issue or transfer of shares and other instruments
  • employment contracts
  • certain civil defence and protection services contracts
  • public transport services contracts by rail or metro
  • certain political campaign services when awarded by a political party in the context of an election campaign.

Certain public contracts for the provision of services are excluded from Part 2 PCR.

Contracting authorities should:

  • consider whether the service contract to be awarded is excluded from Part 2 PCR.
