North Macedonia accession to the agreement on government procurement & CPV code amendments

Overview

This PPN applies to all contracting authorities, as defined by the UK regulations. This includes all central government departments, their executive agencies, non-departmental public bodies and other public sector organisations including utilities (collectively referred to as ‘in-scope organisations’).

This PPN sets out requirements for in-scope organisation following North Macedonia’s accession to the World Trade Organisation’s (WTO) Agreement on Government Procurement (GPA).

The PPN also sets out amendments to two Common Procurement Vocabulary (CPV) codes relating to:

  • 85311200-4: Welfare services for disabled people, and
  • 85312120-6: Day-care services for disabled children and young people.

Objective at this commercial stage

In-scope organisations must comply with the principles of non-discrimination and equal treatment in relation to suppliers from North Macedonia throughout the procurement process.

Key considerations at this commercial stage

In-scope organisations should:

  • ensure suppliers from North Macedonia are treated in accordance with the UK’s international commitments under the GPA (as set out in PPN 02/21 - the WTO GPA and the UK-EU TCA)
  • ensure, where applicable, CPV codes are advertised in the contract notice in accordance with the rules of this PPN (i.e. PPN 12/23).

The PPN should be read alongside the relevant parts of the legal framework, including but not limited to, the following provisions of the Public Contracts Regulations 2015 (which may be particularly relevant to the consideration of this PPN):

  • Regulation 25A: Conditions relating to the GPA
  • Regulation 90: Duty owed to economic operators from certain other states
  • Schedule 1A: Parties to the GPA
