Reduction of the number of otherwise qualified candidates to be invited to participate

Overview

This regulation sets out the rules for contracting authorities on how many suppliers must be invited to tender in restricted procedures, competitive procedures with negotiation, competitive dialogue procedures and innovation partnerships and the methodology for determining this.

Objective at this commercial stage

The number of suppliers invited to participate in the procurement must be at least equal to the minimum number indicated in the contract notice. If the number of suppliers meeting the selection criteria and the minimum levels of ability is less than the minimum number indicated in the contract notice, the contracting authority may continue the procedure by inviting all the candidates with the required capabilities.

Key considerations at this commercial stage

Contracting authorities must:

  • ensure that they do not shortlist suppliers that did not request to participate, or suppliers that do not have the required capabilities.
