Reduction of the number of otherwise qualified candidates to be invited to participate

Overview

This regulation sets out the rules for contracting authorities on how many suppliers must be invited to tender in restricted procedures, competitive procedures with negotiation, competitive dialogue procedures and innovation partnerships and the methodology for determining this.

Objective at this commercial stage

Contracting authorities undertaking restricted procedures, competitive procedures with negotiation, competitive dialogue procedures and innovation partnerships should consider the appropriate, minimum number of suppliers to invite to tender, ensuring compliance with the rules as set out in this regulation (i.e. regulation 65).

Key considerations at this commercial stage

Contracting authorities must:

  • ensure that the minimum number of suppliers invited to participate in a restricted procedure is five, and the minimum number of suppliers invited to participate in a competitive procedure with negotiation, competitive dialogue procedure or innovation partnership procedure is three.
